Delays during the FOIA records process are common and should be expected. Many agencies are understaffed and already backlogged with requests so patience is key. Especially in cases when a request is very complex, it can sometimes take years to fulfill requests.
To help manage this process, it’s advisable to get the names and contact information of specific FOIA personnel to keep tabs on your request. This way, you can avoid the automated answering machines and transfers between departments when calling the agency. You can also get the number of the agency’s FOIA office or write to them to get updates about your request.
As a last resort, if a request is taking significantly longer than reasonable extensions issued by the agency, you are entitled to file a lawsuit to obtain the records you requested. See the section on “Filing An Appeal” for more information.
